KKM Enforces Tobacco Product Control Act

KUALA LUMPUR: Starting today, the Tobacco Product Control for Public Health Act 2024 (Act 852), gazetted on February 2, comes into effect simultaneously with its regulations.

The Ministry of Health (KKM) announced that the enforcement of Act 852 involves several aspects that will be implemented immediately and in phases.

This includes the sale of tobacco products that appeal to children and adolescents, aimed at reducing access to these products.

“Other provisions to be enforced immediately include a ban on advertising, promotion, and sponsorship of tobacco products, as well as restrictions on sales in educational institutions, markets, online, and through vending machines,” KKM explained in a statement.

Educational enforcement will occur over a period of 6 to 12 months from the effective date, specifically for the registration of tobacco products, which will take effect from April 1, 2025.

This includes regulations on packaging and labeling of products, which will be enforced by October 1, 2025, while sales control and display at retail counters will begin by April 1, 2025, at the latest.

KKM emphasizes that the enforcement of these laws requires cooperation and understanding from all parties.

In this regard, educational and advocacy materials will be published to clarify the Act, along with ongoing engagement sessions with industry stakeholders.
